Terms of Service:

In using the Sarah Hobday Counselling website, and by purchasing Resilience products, you are agreeing to comply with and be bound by the terms and conditions of use outlined below.

Throughout this document, the term ‘I’ or ‘me’ refers to Resilience and/or Sarah Hobday Counselling, and as such, represents the views of the business in their entirety.

Sarah Hobday Counselling is registered with the ACC (Association of Christian Counsellors), BACP (British Association for Counselling and Psychotherapy), and the ICO (Information Commissioner’s Office).

Please take the time to read this information before ordering.  These terms and conditions do not affect your statutory rights as a consumer.

 

General Terms and Conditions:

This website is owned and operated by Sarah Hobday Counselling.  If you have any questions about these terms and conditions or if you have any comments or complaints on or about our website or product range, please email me at sarahhobdaycounselling@gmail.com.

 

Processing of your order:

I endeavour to process your order within 48 hours of receiving it.  Provided confirmation that your payment has been successfully processed by no later than the first day of the week (Monday), I shall pack it and prepare it for dispatch no later than the Tuesday of that week.  Delivery times are normally 3 – 5 working days for the UK.  Sarah Hobday Counselling will use all reasonable endeavours to meet the above guidelines.

I am not responsible for delays outside my control.  If my supply of your order is delayed by an event outside my control then I will contact you as soon as possible to let you know and I will take steps to minimise the effect of the delay.  Provided I do this I will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact me to end the contract and receive a refund for any products you have paid for but not received.

 

Refunds:

You have the right to cancel your purchase within fourteen (14) days of receiving your first delivery from Resilience, in which instance I will provide you with a full refund and details on how to return your goods to me.

 

Term and Termination:

I offer subscription terms of 4 weeks.  I shall send you a reminder that your subscription is ending.  If you wish to continue your subscription by purchasing another Resilience plan, please visit the website and select the item you require.  Each plan is a separate purchase, I do not automatically renew the subscription.

 

Transaction Security:

I use Paypal to provide a secure payment gateway to accept your credit card details and process your payment.

 

Damaged Goods:

Sarah Hobday Counselling will make every effort to ensure that products arrive in good condition.  However, in the unlikely event of a product arriving damaged, customers should contact me as above within 14 days of receipt of the product and return it within 5 days for a replacement to be sent.  Products may only be returned if the condition is unsatisfactory due to damage in transit.

 

Availability:

All items are subject to availability.  If the goods you have ordered are not available, I will inform you as soon as possible.

 

Ordering errors:

You are able to correct errors on your order up to the point on which you click on “submit” during the ordering process.  After this point, I will assume that all information provided as part of your order is correct and will process your order accordingly.

 

Delivery:

I will deliver to the address you specify for delivery as part of the checkout process.  It is important that this address is accurate.  If it is not, the delivery of any replacement item may need to be covered by the buyer.  I cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions.  I will aim to deliver the goods within the timescale quoted on my website, but delivery times are not guaranteed.  If delivery is delayed due to any cause beyond my reasonable control, the delivery date may be extended by a reasonable period.  Any change in the address for future deliveries must be provided at least 2 weeks in advance, in order to ensure that items are not sent to an incorrect address.

 

Risk and ownership:

Risk of damage to / loss of goods passes to you at the time of delivery.  Goods supplied are not for resale.

 

Acknowledgement and acceptance of your order:

You must provide me with a valid email address.  I will notify you by email as soon as possible to confirm receipt of your order and associated details.  An acceptance of your order will take place on dispatch of the good(s) ordered.

 

Cancellation rights:

Under the Consumer Contract Regulations you have the legal right to cancel your order within fourteen (14) days of receipt of your goods (with the exception of any made to order items).  In order to do so, please contact me at sarahhobdaycounselling@gmail.com.

 

Reasons I may suspend the supply of products to you:

I may have to suspend the supply of a Resilience plan to:

(a) deal with technical problems or make minor technical changes;

(b) update the product to reflect changes in relevant laws and regulatory requirements;

(c) make changes to the product as requested by you or notified by us to you.

I will contact you in advance to tell you I will be suspending supply of the product, unless the problem is urgent or an emergency.  If I have to suspend the product for longer than one month during any subscription term, I will adjust the price accordingly.

 

Changes to legal notices:

I reserve the right to change these terms and conditions from time to time and you should therefore review them before making any purchase.

 

Ownership of rights:

All rights, including copyright, in this website are owned by or licensed to Sarah Hobday Counselling.  Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without my permission.  You may not modify, distribute or repost anything on this website for any purpose, without first seeking my permission to do so.

 

Accuracy of content:

I have taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been fairly described.  All prices are displayed inclusive of VAT & UK Postage.  If the price of the goods increases between deliveries, you will not be affected.  Any weights, dimensions and capacities given about the goods are approximate only.  Product images are used for illustrative purposes only and may differ upon delivery.  To the extent permitted by applicable law, I disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website and I shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials contained on this website.

 

Damage to your computer:

I make every effort to ensure that this website is free from viruses or defects.  However, I cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer.  It is your responsibility to ensure that the right equipment is available to use the website.  I will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

 

Marketing:

I will not actively market to you unless you have accepted my request to do so.  If you had chosen to receive marketing emails and updates but subsequently decide to opt out, please email me at sarahhobdaycounselling@gmail.com.

 

Trading Name:

Resilience is a trading name of Sarah Hobday Counselling.  In all instances where this trading name is used, I am referring to Sarah Hobday Counselling.

Events outside my control:

I will not be liable or responsible for any failure to perform, or delay in performance of, any of my obligations under these terms and conditions that is caused by events outside my reasonable control (“Force Majeure Event”).

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

  • Strikes, lock-outs or other industrial action;
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
  • Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
  • Impossibility of the use of public or private telecommunications networks; or
  • The acts, decrees, legislation, regulations or restrictions of any government

My performance under any Sale is deemed to be suspended for the period that the Force Majeure Event continues, and I will have an extension of time for performance for the duration of that period.  I will use my reasonable endeavours to find a solution by which my obligations under these terms and conditions may be performed despite the Force Majeure Event.

 

Privacy Statement:

Your privacy is important to me.  I will only use the information I collect about you in accordance with the Data Protection Act 2018.  On my site you can order my products, request information and register for promotions or competitions, as a result of which you will be submitting personal information such as your name, address, email address, phone number and credit/debit card information.  You may even submit the name, address and phone number of other people if, for instance, you are ordering a gift for them online.  Personal information is primarily collected in order to process an order you may place on the site, but may also be stored in order that I can provide you with information which you have specifically requested, for example on offers or promotions. I also need your contact details in order to provide you with the best possible service, to inform you if an item is out of stock or to update you on the status of an order.

I do not sell, rent or otherwise share your data or any other personal information you may submit during a visit to this site.   I may make your data make available to third parties working on my behalf to fulfil your order.  Any child or young person under the age of 16 is advised to get the permission of a parent or guardian before submitting any personal data to our site.  I do not collect or store any information from those known to be under 16.

 

My liability:

I warrant to you that any product purchased from me through my site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied.  My liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the product you purchased.

 

Transfer:

I may transfer my rights and obligations under these terms to another organisation.  I will always tell you in writing if this happens and I will ensure that the transfer will not affect your rights under the contract OR I will contact you to let you know if I plan to do this.  If you are unhappy with the transfer you may contact me to end the contract within thirty (30) days of me telling you about it and I will refund you any payments you have made in advance for products not provided.

 

Severability:

If any of these terms and conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms and conditions which will continue to be valid to the fullest extent permitted by law.

 

Entire Agreement:

These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of this Agreement and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.  We each acknowledge that neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to an order except as expressly stated in these terms and conditions.  Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any order (unless such untrue statement was made fraudulently) and the other party’s only remedy shall be for breach of contract as provided in these terms and conditions.

 

Law, jurisdiction and language:

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law.  Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales.
